NOTICE OF PUBLIC HEARING ON INTENTION OF SAN JOSE UNIFIED SCHOOL DISTRICT TO CONSIDER GRANTING EASEMENTS

NOTICE IS HEREBY GIVEN of the intention of the Board of Education (“Board”)
of the San Jose Unified School District (“District”) to consider granting easements (“Easements”) to the San Jose Water Company for the purpose of installing, constructing, operating, maintaining, repairing, reconstructing, removing, and replacing public utilities, including pipelines, conduits, cables, wires, gas and water mains and lines, but not any high pressure gas lines, and all appurtenances thereto at the District’s Trace Elementary School, located at 651 Dana Ave, San Jose, CA 95126, County of Santa Clara, pursuant to Education Code sections 17556 et seq.

The time and place set for the public hearing regarding the intention of the Board to consider granting the Easements is November 20, 2008 at 6:30 p.m., or as soon thereafter as practicable, at the District’s Board Room, 855 Lenzen Avenue, San Jose, CA 95126.  The testimony of all interested persons for or against the proposed Easements will be heard at that time.  Protests may be made orally or in writing.  Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularities and defects to which the objection is made.  All written protests shall be filed with the Clerk of the District on or before the time set for the hearing.  The District may waive any irregularities in the form or content of any written notice and at the hearing may correct minor defects in the proceedings.  Written protests may be withdrawn, in writing, at any time before the conclusion of the hearing.
