School Policies


Attendance

The regular and punctual attendance of students is expected, encouraged and as necessary, enforced.  The California Education Code and the Welfare and Institution Code provide that legal action may be taken against a student and /or parent when a student is truant.  California Education Code 48200 requires compulsory, full-time education for all children ages 6-18.
California Education Code 48260: “Any pupil subject to compulsory full-time education who is absent from school without valid excuse three full days in one school year or tardy or absent for more than any 30 minute period during the school day without a valid excuse on three occasions in one school year, or any combination thereof, is a truant and shall be reported to the attendance supervisor or to the superintendent of the school district.” As a result of the violation of Ed Code 48620, San Jose Unified School District may declare your student legally truant.  Further steps may include a referral to the San Jose Unified School Attendance Review Board (SARB) or to a District Attorney (DA) Mediation session.


Electronic Devices

Students may possess or use personal electronic signaling devices including cell phones. Devices with the capability to capture digital images and/or take photographs of any kind are prohibited.  BP5131(e) Cellular phones and pagers must be turned off during class (prohibition on text messaging, ringing or vibrating) and must be kept in the student’s purse or backpack at all times during school hours, or while under the supervision and control of school district employees. Electronic devices, which are prohibited, are portable music devices (i.e. I Pod, MP3, CD,); laser pointers, or electronic game devices.
If a disruption occurs, the school staff shall direct the student to turn off the device and/or confiscate it.  If a school staff finds it necessary to confiscate a device, he/she may either return it at the end of the class period or school day or keep it until the principal or designee has consulted with the student’s parent/guardian. A student who violates this policy may be prohibited from possessing a personal electronic device at school or school- related events Schools are not responsible for lost or stolen IPOD’s or cell phones.  The videoing or picture taking of any fight or inappropriate behavior may result in suspension, expulsion or other disciplinary action.


Uniform Policy

John Muir Middle School is a uniform school.  Students have a variety of clothing options that will allow them to be comfortable and ready to participate in school activities.  Compliance with the uniform code is strictly enforced to ensure school wide participation, acceptance and safety.
