Pay Development Fees
California school districts may impose development fees on new residential or remodeling projects, as well as commercial and industrial construction. These fees are intended to provide funds for the construction or reconstruction of school facilities. California law specifies the purpose and restrictions for the fees and has procedures for their implementation, accounting, and use.
Annual and Five-Year Developer Report
- What are the current fees?
The current developer fees in San José Unified are as follows:
Residential: $4.79 per square foot
Commercial/industrial: $0.78 per square foot
Mini Storage: $0.05 per square foot- How are fees assessed?
Fees for a residential project are assessed per square foot of accessible space. This includes the units themselves, gyms, and/or community rooms. It does not include carports, garages, patios, walkways, inside corridors, etc. Fees for commercial/retail space are assessed per square foot of the entire project.
In all cases, if the development involves demolition of an existing structure(s), the square footage of the demolition is deducted from the square footage of the new construction for the purpose of assessing fees. For example, if a new development is 1,000 square feet and involves demolition of a 200-square-foot structure, fees would be assessed for 800 square feet.
- How do I pay my fees?
When you submit your development project to the City of San José or County of Santa Clara, you will receive a School District Referral Form. Bring this form to the San José Unified District Office with your payment. Upon payment, you will be provided with two copies of all documentation – one to return to the City or County, and one for your records.
The District Office is located at 855 Lenzen Avenue, San José, CA 95126 (off the Alameda). Our office hours are 8:00am to 5:00pm, Monday through Friday. Please park in the Visitors Parking Lot (middle lot with green striping) and use the Business Entrance (under the San José Unified marquee).
PLEASE NOTE: San José Unified only accepts check, cash, or bank draft for developer fees. We are unable to process credit card transactions.
- Is there a different process for multi-unit residential developments?
The process for multi-residential developments is the same as the residential and commercial process. Bring your School District Referral Form from the City of San José or the County of Santa Clara with your payment. Upon payment, you will be provided with two copies of all documentation – one to return to the City or County, and one for your records.
- Who sets the fees?
The State Allocation Board adjusts developer fee rates in January of even-numbered years. Fees can only be increased when the school district’s Board of Education has completed and adopted a new justification study. Districts must account for the collection of the fees and maintain a developer fee account that is separate from other funds.
- How are the fees used?
Developer fees are intended for the construction or reconstruction of school facilities. Fees cannot be used for computers, furniture, school supplies such as books, or routine maintenance.
- What if I disagree with the assessment?
Developer fees are calculated based on information provided to San José Unified by the City of San José or County of Santa Clara on your School District Referral Form. If you disagree with the information on the School District Referral Form, please resolve the dispute with the City or County prior to coming to the San José Unified District Office to pay your fees.

Town Hall Meetings
In an effort to bring the district office to you, San José Unified hosts a series of district-wide “town hall” meetings throughout the school year. These meetings are an open forum for our families, staff, students, and community members to offer questions, comments, suggestions, and concerns about the district, our schools, and our programs.
As with the open comment period at our Board of Education meetings, any member of the public can speak for up to two minutes or fill out a comment card. Following each town hall, our staff synthesizes all of the comments we receive and provide responses or additional information from the appropriate departments.
We invite you to join us at our next town hall. Can’t attend in person? We’re exploring the opportunity to live stream these and other district events. Stay tuned!
- Upcoming Town Halls
Due to COVID-19, all Town Hall meetings have been suspended for the time being. Please check back often for updates and announcements.

Immigration Resources
San José Unified welcomes all students, regardless of their immigration status. However, many of our students and families are experiencing anxiety and uncertainty as a result of some of the proposed policy changes at the federal level.
With that in mind, the Board of Education passed a resolution on February 9, 2017, supporting immigrant students and families. You can click here to read the resolution.
Additionally, Superintendent Nancy Albarrán has joined 55 superintendents from across the country in signing on to this letter from the Broad Center, standing with DACA Dreamers and our immigrant community.
- DACA Resources
In light of recent announcements regarding the federal Deferred Action for Childhood Arrivals (DACA) program, the Santa Clara County Office of Immigrant Relations has created these resources to assist DACA youth and their families:
DACA Frequently Asked Questions (FAQ): English | Spanish
UPDATE:
The U.S. Department of Homeland Security has announced that the agency is accepting DACA renewal applications from certain individuals at this time.
It is extremely important that any individual who needs to file a DACA renewal application and did not do so prior to October 5, 2017, do so IMMEDIATELY, without any delay.
The federal government is seeking a reversal of a recent court order that they must continue to accept DACA renewal applications. Should that order be reversed, the renewal process will be closed immediately. That could happen in a matter of days. (Presumably, if the process is closed by court order, all renewal applications in the pipeline will be dealt with according to the procedures in place at this time.)
Here are the current rules and explanations for who may renew at this time. (The reference to USCIS is the United States Citizenship and Immigration Services bureau of the Department of Homeland Security):
1. If your DACA expired on or after September 5, 2017, you may send your DACA renewal applications to USCIS. This means you must fill out the latest versions of Form I-821D, Form I-765 Application for Employment Authorization, and Form I-765 Worksheet.2. If your DACA expired before September 5, 2017, you must reapply through an initial application, not renew. Everyone must include the date your DACA expired or will expire on Part 1 of the Form I-821D.
3. USCIS will not accept any new or first-time DACA applications.
4. Requests for advance parole from DACA recipients will not be accepted.
